The government issued a positive opinion on the draft amendments to the Law on Permission of Construction Work and the initiative to introduce a construction moratorium in Chisinau

The first bill, initiated in parliament, provides that the issuance of a town-planning certificate for construction will be carried out only with the consent of all co-owners, as well as the neighbors of the building / land plot. The second legislative initiative provides for the establishment of a moratorium on the permission and continuation of construction work on new facilities inside the existing residential areas of the municipality in cases where the distance between the new facility and existing buildings is less than the height of the tallest building. At the same time, the started construction work can be continued only with the provision of a protocol that contains a positive result of public consultations organized for this purpose, and proof of the delivery of the conclusion to the owners of real estate / adjacent land plots about the date of the organization of public consultations. During the government meeting, the Minister of Economy and Infrastructure Vadim Brinzan noted that, in general, both projects must be approved, since there are significant problems in the areas they affect. However, the minister proposed to finalize both projects and take into account some points. For example, it is necessary to establish the exact timing provided to the neighbors in order to submit their agreement or disagreement with the new construction, as well as consider the situations when the neighbors did not reach a consensus on this issue. As for the moratorium on the construction, it is necessary to prepare an analysis of the impact of the regulation of this project on the business environment, analyze its financial, economic and social impact, as well as hold consultations with local authorities, civil society, and construction companies. In this case, the bill must specify the exact period of the moratorium. According to the ministry, the introduction of a moratorium may adversely affect the construction companies, they may incur financial losses, as well as their employees and customers. The ministry proposed the government to support the project, and take into account the voiced recommendations when finalizing the bills. // 19.07.2019 - InfoMarket.
